Terms of Service

These Terms of Service (the “Terms”) form a legally binding agreement between NexSimpleLab (“we”, “our”, or “us”) and you (“User”, “you”, or “your”) governing your access to and use of our website, products, and services (collectively, the “Services”).

We reserve the right to suspend or terminate accounts that violate these Terms or engage in misuse of the Services.

6. Payments

All payments are processed through third-party platforms, including Etsy, Payhip, and Whop.

Depending on the platform and transaction type, the respective platform may act as the Merchant of Record (MoR) or payment intermediary responsible for payment processing, billing, and the collection and remittance of applicable taxes in accordance with their own policies and applicable laws.

By completing a purchase, you acknowledge and agree that your payment is subject to the terms, conditions, and payment procedures of the respective platform used to complete the transaction.

We do not collect, store, or directly process your payment information. All payment data is handled securely by the respective third-party payment platforms in accordance with their privacy and security policies.

7. Refund Policy

Due to the digital nature of our products, all sales are generally final and non-refundable.

Refunds may be granted if:

  • The product is defective or not as described.
  • A critical issue cannot be resolved within a reasonable timeframe.

8. Third-Party Services

The Services may integrate with or rely on third-party services. We are not responsible for:

  • The availability or reliability of third-party services.
  • Their policies, content, or practices.
  • Any damages arising from their use.

9. AI Tools Disclaimer

Our Services may include features powered by third-party artificial intelligence providers, including but not limited to Google Gemini. By using these AI-powered features, you acknowledge and agree that:

Your inputs may be transmitted to and processed by third-party AI providers.
We do not control how third-party providers process, store, or use such data.
We are not responsible for the data handling practices of third-party AI providers.
AI-generated outputs are for informational purposes only and may be inaccurate or incomplete.
Use of AI features is at your own risk.

Important Reminder:

You should avoid submitting sensitive, confidential, or personal information when using AI features. You are responsible for verifying any outputs before relying on them.

10. Intellectual Property

All content, including products, designs, and materials provided by NexSimpleLab, remain our exclusive intellectual property. You are granted a license to use the products, not ownership.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, or consequential damages.
  • We are not responsible for loss of data, profits, or business opportunities.

The Services are provided on an “as is” and “as available” basis without warranties of any kind.

12. Termination & Changes

We may suspend or terminate your access to the Services at any time if you violate these Terms.

We may update or modify these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
